Time for Malaysia to address minorities' concerns: HINDRAF

Chennai (PTI): Malaysia-based Hindu Rights Action Force (HINDRAF) on Monday said the defeat of Malaysian Indian Congress headed by former minister Datho Samivelu in recent polls, showed that it was time for the Malaysian government to come out with an "affirmative plan" to address the concerns of the minorities.

P Wayda Moorthy, Chairman, HINDRAF, told reporters here that after the elections, Prime Minister Abdullah Badawi had said that he would correct some of his mistakes like the crackdown on ethnic Indians.

Moorthy said the Government should announce "concrete, affirmative plan for the Indians."
He also called for repealing of the Internal Security Act under which several HINDRAF activists were detained and demanded their immediate release. They were detained when HINDRAF organised a rally of ethnic Indians on November 25 last year, demanding equal rights to the community.

Moorthy said the recent MoU proposed by Malaysia offering all rights and facilities to the Indian expatriates and migrant workers was aimed at keeping India quiet.

"Migrant workers from various countries are employed in Malaysia. But, the proposed MoU for Indians alone is aimed at preventing India from taking up with it, the struggle by the ethnic Indians," he said.

Malaysia’s Hindraf leader opposes ‘only Indians’ deal [IANS]
Malaysia’s interest in signing an agreement with India to protect Indian workers is a diversionary tactic intended to keep the latter quiet on the rights of Malaysians of Indian origin, a leader of the Hindu Rights Action Force (Hindraf) said here Monday.

“Such an MoU (memorandum of understanding) protecting just the Indian workers’ rights will effectively silence the government of India on the issue of rights of Malaysians of Indian origin,” said Hindraf leader P. Waytha Moorthy.

“There are workers of all nationalities in Malaysia and the country has enough laws to protect foreign workers. An MoU with India will only create discrimination between foreign workers in Malaysia.”

Moorthy, who frequently visits Tamil Nadu, also called for immediate release of five Hindraf leaders being held for over 100 days in Malaysian jails under the draconian Internal Securities Act (ISA) of that country.

He said: “Hindraf will continue to fight for the abrogation of this Act.” Hindraf has demanded that Malaysian Prime Minister Dato Seri A.A. Badawi “table an act (in parliament) to repeal the ISA in the forthcoming session due to be held in May”.

The Hindraf leader, against whom an arrest warrant has been issued in Malaysia, also appealed to the Indian prime minister and the Tamil Nadu chief minister to intervene to secure the release of the Hindraf leaders.

Hindraf, which claims to speak for the two million Malaysians of Indian origin, has courted controversy since last November when it held a rally that was forcibly dispersed.

Five of its top leaders, who organised the rally, have been accused of trying to destabilise the state and detained for two years under the ISA.

Moorthy also claimed that Hindraf was the “new voice of Malaysian Indians”.

“The fact that in the March 8 elections, most of the candidates of the Malaysian Indian Congress (MIC) including (its chief) Samy Velu lost shows that Hindraf is the new voice of Malaysian Indians,” he said.

“The election result shows people no longer believe Velu,” Moorthy told IANS.

“We now hope that the Badawi government will now at least stop denying the marginalisation of Malaysians of Indian origin and undo the 50 years of violation of their rights,” he said.

“We have proved people’s power (Makkal Shakthi). The Muslim Malaysians and Malaysians of Chinese origin are now taking inspiration from the Hindraf movement and are demanding their rights,” Moorthy said.

The Hindraf leader urged the new Malyasian government to “seriously consider Hindraf’s 18-point demand”, and “initiate the mechanism to come out with and implement concrete plans to correct the economic and opportunity violations against Malaysians of Indian origin”. [THE END]

Hindraf chief’s plea to Badawi [Deccan Chronicle]

Chennai, March 24: Malaysia’s Hindu Rights Action Force (Hindraf) chairman Waydamoorthy on Monday said that since the Malaysian Abdullah Badawi had accepted the setback his coalition had suffered in the recent elections, his government should use the opportunity to mend its relations with the minorities and come out with a “concrete, affirmative plan for the Malaysian Indians.” Talking to reporters in Chennai, Mr Waydamoorthy also demanded the repealing of the Internal Security Act under which some Hindraf leaders are detained in Malaysia. They have been detained since HINDRAF organised a rally of ethnic Indians on November 25 last year demanding equal rights to the community. “It is more than 100 days since they were arrested by the authorities under the act and it is the most misused act in the country,” he alleged.

Urging the Prime Minister to table a proposal for repealing the act when the Parliament meets on May 5, Mr Waydamoorthy said the “act must go as it permits the authorities to detain anyone in jail for an unspecified period without any trial.”

Mr Waydamoorthy said Hindraf had made a terrific impact in Malaysian politics and now the other minorities like Malay Muslims and Chinese, who were afraid of raising a banner of revolt, got emboldened and voted for the opposition party in the elections.

“The government made use of the local media and tried to portray Hindraf as a dangerous terrorist outfit. It cannot be done anyone,” he said. Asked about Hindraf's expectations, he said the government should implement 20 per cent reservation for Tamils in top government jobs, besides Ringitt 100 billion financial allocation in the 9th economic plan. Hindraf has already submitted charter of demands containing 18 points before the government. “The government must recognise us as socio-political organisation fighting for the rights of people and invite us for talks,” he said. Malaysia Government bulling India: HINDRAF [New Indian Express]

CHENNAI: Hindu Rights Action Force (HINDRAF) on Monday cautioned the Indian Government of a trap laying ahead in signing a pact with Malaysia rulers on the issue of expatriates.

The Malaysian Government's assurance of safeguarding rights of Indian expatriates by signing an accord with Central is a step to bully India, said P Waytha Moorthy, Chairman, HINDRAF.

“What is the necessity for Malaysia Government to sign a MoU particularly with India Government, while expatriates from across the world works there?,” questioned Moorthy, while addressing the press on Monday.

Their perseverance is to soften the Centre views on Indian problems in Malaysia, he stated. The recent election results in Malaysia have also proven that the welfare of minority Indian communities were no longer taken care off, as propagated by the Government, he said and added that the Prime Minister Abdullah Badawi in the aftermath of the election had openly admitted that there are lessons to be learnt from the election results.

He urged the minority Badawi government to release the five persons linked to HINDRAF under the Internal Security Act without any conditions and to pay adequate compensation to them for their sufferings.

The Malaysia Government should repeal the ISA in the forthcomings new parliamentary sessions and to accept the 18 point demands of HINDRAF. The PM should also inform the Indian minorities about the plans for the welfare of the communities. [THE END]

PRESS RELEASE :

The recent election results have proven that the Minority Indian community no longer believes the Government propaganda that the Indian welfare is taken care off. They have shown through their ballot box that the Barisan National Government have failed them and have totally lost confidence in the present Government.

Prime Minister in the aftermath of the elections had openly admitted that there are lessons to be learnt from the election results. He stressed that he is not a stubborn person and not a person who will not be willing to learn from previous mistakes.

The following are amongst the mistakes committed by the BN Government that HINDRAF wishes to highlight:

a) arrest and detention of 5 persons linked to HINDRAF under the Internal Security Act which means detention without trial for an unspecified period of time;

b) branding HINDRAF as an extremist organization having links to terrorist organizations which is not believed by the Malaysian public and admitted by a senior minister that there are no evidences to those accusations;

c) declaring HINDRAF an illegal organization and refusal to formally approve HINDRAF as a legitimate organization;

d) Failing to address the 18-point demands made and submitted by HINDRAF to the Prime Minister to undo 50 years of oppression suppression and marginalization of the ethnic minority Indian community in Malaysia.

e) Deliberately using the local media, which is controlled by Government to demonize HINDRAF in the eyes of Malaysian public as a dangerous organization, which is a threat to National Security.

f) Continuous denial of the right to Freedom of Assembly under Article 10 of the Federal Constitution and disruption of peaceful and legitimate gatherings of HINDRAF supporters throughout the country.

g) Violent attack on HINDRAF supporters especially at the Nov 25th and Feb 16 peaceful gatherings.

h) Unlawful arrests and trumped up criminal charges of attempted murder and unlawful assembly on HINDRAF supporters.

i) Intimidation and threat of arrest of venue owners who let out halls for HINDRAF meetings.

j) Intimidation and harassment of local HINDRAF leaders.

HINDRAF calls upon the Government of Malaysia to:
• Seriously look into the 18-point demands made by HINDRAF and initiate negotiations with HINDRAF on the mechanism and concrete plans to be adopted to help rectify the economic imbalance and the 70% poor and underclass Indians.

• Immediately release the 5 linked to HINDRAF without any conditions and adequately compensate them for their sufferings and lost days;

• Recognize the legitimate existence and contributions of HINDRAF to the country and to immediately approve the registration of HINDRAF as a Civil Rights and Political Pressure group/organization;

• Prime Minister to table as the first act of Parliament, an act to repeal the ISA in the forthcoming new Parliamentary session;

• heed calls made by all concerned citizens and Human Rights organizations to immediately release all detained persons unlawfully held under the ISA and compensate each individual for the loss of years and sufferings they and their families underwent;

• accept the reality that HINDRAF IS THE NEW VOICE OF MALAYSIAN INDIANS.

அன்மையில் மலேசியாவில் நடைபெற்ற தேர்தலே மலேசிய-இந்தியர்களுக்கு இழைக்கப்பட்ட அநீதியின் வெளிப்பாடாய் அமைந்தது. பாரிசான் தேசிய அரசின் தோல்வியும், தற்பொழுதுள்ள அரசின் மீதிருந்த மக்களின் நம்பிக்கையின்மையும் தேர்தல் வெளிப்பாடாய் அமைந்தது.

மலேசிய தலைமை அமைச்சர் தேர்தல் தோல்வியின் முடிவு ஓர் பாடத்தை புகட்டியதாய் வெளிப்படையாக ஒப்புக்கொண்டார். இத்தோல்வியை மனதில் கொண்டே, இனி தான் முன்போல் தவறை இழைக்க மாட்டேன் என்றும், மக்களின் மனதை அறிந்து செயல்படுவேன் என்று உறுதியளித்துள்ளார்.

பாரிசான் தேசிய அரசு செய்த தவறுகளை கீழே இந்துரப் தொகுத்துள்ளது:

1. பயங்கரவாத சட்டமான, உள்நாட்டுப் பாதுகாப்பு சட்டத்தின் கீழ் 5 இந்துரப் ஆதரவாளர்களை சிறைப்படுத்தப்பட்டுள்ளதையும், அவர்களிடம் எந்தவித விசாரணையோ அல்லது அவர்கள் சிறைபடுத்தப்பட உள்ள காலமோ கணிக்கப்படாமல் இருக்கின்றனர்.

2. இந்துரப் அமைப்பை ஒரு பயங்கரவாத அமைப்பாக தொடர்பு படுத்தி சொல்லப்பட்டதை மலேசிய பொதுமக்களும், அங்குள்ள அமைச்சர்களுமே நம்பும்படியான ஆதாரம் எதுவும் இதுவரை வைக்கப்படவில்லை.

3. இந்துரப் ஒரு நேர்மையான அமைப்பாய் அங்கிகரிக்காமல், அதை ஒரு சமூக விரோத அமைப்பாய் சொல்லப்பட்டதை ஏற்க கூடியதாய் இல்லை.

4. கடந்த 50 ஆண்டுகளாய் ஒடுக்கப்பட்ட மலேசிய-இந்தியர் சிறுபான்மையினரின் உரிமைகளை இந்துரபின் 18 அம்ச கோரிக்கைளை இதுவரை அரசு கவனத்தில் கொள்ளவில்லை.

5. உள்@ர் அரசு ஊடகங்களைப் பயன்படுத்தி, இந்துரப் ஒரு பயங்கரவாத அமைப்பாயும், தேசிய பாதுகாப்புக்கு குந்தகம் விளைவிக்கும் அமைப்பாகவும் பொது மக்களிடம் சித்தரிப்பது ஏற்றுக்கொள்ள முடியாதது.

6. அரசியல் சாசனம் பிரிவு 10த்தை காண்பித்து, இந்துரப் அமைப்பின் ஆதரவாளர்களை நாட்டின் எந்த பகுதியிலும் அமைதியாகக்கூட ஒன்று கூட விடாமல் தடுக்கப்படுவது ஏற்றுக்கொள்ளக் கூடியதாய் இல்லை.

7. அமைதியான முறையில் குறிப்பாய் நவம்பர் 25, 2007 மற்றும் பிப்ரவரி 15, 2008 அன்று ஒன்று கூடிய இந்துரப் ஆதரவாளர்களை இரும்பு கரம் கொண்டு காட்டுமிரண்டித்தனமாய் தாக்கப்பட்டதை எவருமே ஏற்றுக்கொள்ள மாட்டார்கள்.

8. சட்ட விரோதமாய் இந்துரப் ஆதரவாளர்களை சிறைப்படுத்துதலும், அவர்களின் மேல் கொலைக் குற்றச் சாட்டுகளை புனைவதையும் யார் ஏற்பார்கள்?

9. இந்துரப் கூட்டங்களுக்கு இடம் தரும் அரங்கு உரிமையாளர்களை சட்டத்திற்கு புறம்பாய் மிரட்டுவதும், அவர்கள் கைது செய்யப்படுவார்கள் என்று அச்சமூட்டுவதும் ஏற்றுக்கொள்ளகூடியதாய் இல்லை.

10. இந்துரப் தலைவர்களை சட்டத்திற்கு புறம்பாய் மிரட்டுவது, அச்சுறுத்தப்படுவதையும் தடுக்க வேண்டும்.

மலேசிய அரசின் பார்வைக்கு, இந்துரப் முன் வைப்பது:

• 70 சதவீத மலேசிய-இந்தியர்களின் பொருளாதார சமச்சீர் பெற இந்துரப் முன் வைத்துள்ள 18 அம்ச கோரிக்கையை அரசு உடனடியாய் ஏற்றுக் கொண்டு, பேச்சு வார்த்தைக்கு அழைக்கப்பட வேண்டும்.

• 5 இந்துரப் ஆதரவாளர்களை எந்த வித நிபந்தனைகளுமின்றி உடனடியாய் விடுதலை செய்வாதோடு மட்டுமின்றி அவர்கள் துன்பப்பட்ட நாட்களுக்கு நட்ட ஈட்டுத் தொகையை வழங்கப்படவேண்டும்.

• சமுதாயம் மற்றும் அரசியல் உரிமைக்காக பாடுபடும் இயக்கமாய் இந்துரப் உடனடியாய் அங்கிகாரம் கொடுக்கப்படவேண்டும்.

• மலேசிய நாட்டின் தலைமை அமைச்சர் தற்போது கூட்டும் முதல் நாடாளுமன்ற கூட்டத்திலேயே முதல் சட்டமாய், “உள்நாட்டுப் பாதுகாப்பு சட்டத்தினை” திரும்பபெறும் சட்டம் இயற்றப்படவேண்டும்.

• மலேசியவின் மனித உரிமை அமைப்புகளும், இன்னும் பிற அமைப்புகளும் ஏற்கனவே கோரியபடி “உள்நாட்டுப் பாதுகாப்பு சட்டத்தில்” சிறைப்படுத்தப்பட்டுள்ள அனைவரையும் எந்தவித நிபந்ததையுமின்றி விடுதலை செய்து, அவர்களுக்கு நட்ட ஈட்டுத் தொகை வழங்கப்பட வேண்டும்.

• இந்துரப், மலேசிய-இந்தியர்களுக்கான புதிய குரலாய் அரசு ஏற்று செயல் படவேண்டும்.

India should impose economic sanctions on Sri Lanka – M.K.Sivajilingam TNA MP in Manitham Press meet at Chennai

A Tamil Parliamentarian late last week urged India to immediately impose economic sanctions on Sri Lanka, while also reiterating that the LTTE will not be defeated by the Sri Lankan Government or the military.

Tamil National Alliance (TNA) MP, M.K. Sivajilingam told a hurriedly convened news conference in Chennai on Saturday that the Indian Government should not encourage the Sri Lankan military operation by supplying arms to Sri Lanka but instead, the Indian Government should play for a peace settlement in the island.

The news conference was organised by Manitham - Human Rights Organisation in Chennai. Sivajilingam also blamed President Mahinda Rajapaksa for the death of TNA MP M.K. Sivanesan.

“There is no guarantee of security for the TNA MPs, they might be killed at any moment by the government or the government backed para-military groups,” Sivajilingam alleged. He also volunteered to quit his Parliamentary seat, if it would pave the way for the Tamil Eelam. “India should accept the struggle for self determination of Tamils in Sri Lanka,” he said. Sivajilingam noted that on a daily basis Sri Lanka Air Force drops bombs on the ‘Tamil Eelam area.’

“India should intervene in this matter and should order to stop this menace. If the Tamil Eelam is originated, it will be a good friend to India and will always support India,” the TNA MP said. Sivajilingam also called on the international community to urge the Sri Lanka Army to withdraw from Tamil areas.

5. Human Rights Watch has released its report on disappearance in Sri Lanka. The report title itself reflects the Sri Lankan govt. position. The title of the report is "Recurring Nightmare - State responsibility for disappearance....."

6. The recent withdrawal of IIGEP has shown that Sri Lankan govt. is not respecting to Human Rights.

7. Indian Govt. should not encourage by supplying arms to Sri Lanka. Instead, the Indian Govt. should play for Peace Settlement of Sri Lanka.

தமிழ் தேசியக் கூட்டமைப்பின் பாரளுமன்ற உறுப்பினர்களையும் தமிழ் மக்களையும் தொடர்ச்சியாக படுகொலை செய்து வரும் இலங்கை அரசாங்கத்தின் மீது இந்திய பொருளாதர தடை விதிக் வேண்டும்மென தமிழ் தேசியக் கூட்டமைப்பின் யாழ்.மாவட்ட பாரளுமன்ற உறுப்பினர் எம்.கே.சிவாஜிலிங்கம் வலியுறுத்தயுள்ளார்.

சென்னையில் தங்கியுள்ள சிவாஜிலிங்கம் எம்.பி.தமது பாரளுமன்ற உறுப்பினர் கி.சிவநேசன் கிளைமோர் தாக்குதலில் படுகொலை செய்யப்பட்டமை தொடர்பாக இந்திய ஊடகங்களுக்கு பேட்டியளிக்கையிலே அவர் இந்த கருத்தை வெளியிட்டுள்ளார்.

நாடாளுமன்ற உறுப்பினர் சிவநேசன் கொல்வபட்டதற்கு இலங்கை ஜனாதிபதி ராஜபக்சவும் ,இலங்கை அரசம் பொறுப்புபேற்க வேண்டும் என்றும் ஏனைய தமிழ் தேசிய கூட்டமைப்பு நாடாளுமன்ற உறுப்பினர்களின் உயிர்களுக்கும் உத்தரவாதம் இல்லை என்றும் எந்தவேளையும் தாங்கள் கொல்லப்படலாம் என்றும் அவர் குறிப்பிட்டுள்ளார்.

கொசோவோ போல விரைவில் சுதந்திரம் தமிழ தனியரசை அமைக்கும் வரை தங்களுக்கு எந்தப் பாதுகாப்பும் இல்லை. என்றும் தமிழீழத்திற்காக தமது நாடாளுமன்ற உறுப்புரிமைய தூக்கி எறியத் தாயராக இருப்பதாகவும் அவர் சுறினார் தமிழ் மக்களின் சுய நிர்ணய உரிமை பேராட்டத்தை இந்தியா ஏற்றுக்கொள்ளவேண்டும் என்றும் சிவாஜிலிங்கம் வலியுறுத்தியுள்ளார்.

இலங்கை மீது பொருளாதர தடை விதிக்க வேண்டும். தமிழக மீனவர்கள் தாக்கப்படுது குறித்து ஜ.நா.சபையில் இந்தியா புகார் செய்து நடவடிக்கை எடுக்க கோர வேண்டும் என்றும் அவர் மேலும் தெரிவித்துள்ளார். [THE END]

Report on WORKSHOP ON "HUMAN RIGHTS" by MANITHAM-TRICHY

A workshop on HUMAN RIGHTS was organised in TRICHY by the Trichy MANITHAM team in association with SNEHAM on Dec. 10, 2007.

This workshop was organised at CAUVERY COLLEGE FOR WOMEN A/C SEMINAR HALL for the PG students of social work, Human Rights and rehab. science of various colleges in Trichy exclusively the final year students.

The students were provided with a file containing Handbills, documents and other printed material , all related with Human rights, child labour, bonded labour, constitution, UN declaration , a hand book on RTI ,etc along with a notepad and a pen.

The workshop was inaugurated by the vice-principal and the HOD of social work Dr.S. SANKARI by 10:20 am and the first session was handled by sr. advocate Mr. MARTIN with power point presentation and after that a tea break.

The second session was handled by Mr. k. CHANDRASEKAR , the Director of DEW, an NGO working on bobded laour issue. After his session , with a preface of Mr. PAUL GUNA . our MANITHAM Child Labour video show was shown.

After the lunch break, the interractive session was handled by sr. Advocate Mr. J KENNEDY and our MANITHAM member advocate Mr. LEO ROZARIO, which really was an interesting and informative one.

The felicitation ceremony started at 4:20 pm , when the chief guest Hon'ble Addl. District Judge MR. V. RAMAMURTHY arrived.

The secretary of the college and our Trichy dist. Manitham secretary Mr. THANDESAN spoke. The chief guest addressed the gathering and them asked us to take an oath against Human Rights violations and then distributed the participation certificates. All the guests were honoured by the college, Manitham and Sneham.

Vote of thanks was delivered by the co-ordinator of MANITHAM and the managing trustee of SNEHAM Mr. PAUL GUNA LOGANATH .

This works was really informative and the number of participants were 160 students excluding the staff and manitham members.

This workshop was well covered by press which included DINAMALAR, DINAKARAN, THE HINDU, DINAMANI ETC.
